Chief Justice Blocks Government Deportations

Earlier today the Chief Justice overturned a recent list of deportations the Government had put forward. The Chief Justice siting the failure of the Government to provide him with 24 hours notice. He therefor announced that the High Court rejected the Governments request siting The Department of Immigration and Border Protection Act s vii(i). He also stated that the Governments deportations would only come into effect the following day post election, assuming the current make up of the Australian Government would be maintained.

This move though perfectly justified under law comes fairly unprecedented. Prior deportations have never been subject to be overturned by the High Court. Ever since the law came into effect the Chief Justice has claimed that he has never received a list of deportations to be approved (the Act specifying such an action must take place). It’s most likely due to the election period currently in full swing in Australia that the Chief Justice has decided to act and most likely encourage the Government to remain in its caretaker role until the results are finally published.
